Introduction

KANDINSKY (Site and Services) is operated by Komrade Kiev Ltd (“KANDINSKY,” “we,” “our,” or “us”). By accessing the Site or using any services or content provided through it (the Services), you agree to these terms and conditions (the Terms), which form a legally binding agreement between you and KANDINSKY. Anyone who uses the Site and Services is considered a User, whether or not they have an account.
These Terms constitute the entire understanding between you and KANDINSKY. They supersede all prior agreements or understandings, whether written or oral. No variation of the Terms is effective unless made in writing and signed by the parties or their authorised representatives.
If anything in printed or offline materials conflicts with the Terms, the Terms take priority. If any part of the Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that part will be severed. The remaining Terms will continue in full force, remain binding, and enforceable.
Failure or neglect by KANDINSKY to enforce any provision of the Terms at any time does not amount to a waiver of our rights. Choosing not to enforce a condition does not waive any rights. Except where expressly stated, the rights and remedies under the Terms are cumulative and not exclusive. Exercising one right does not prevent KANDINSKY from exercising any other rights or remedies.
KANDINSKY may update or amend the Terms at any time by giving at least 7 calendar days’ notice. Continued use of the Site or Services after notification means you accept the changes. You are responsible for ensuring your email address remains up to date on your ACCOUNT page.
If you are dissatisfied with the Site or Services, or with these Terms, your sole remedy is to stop using the Site and Services.
1. ACCESS TO THE SITE & SERVICES
You may access and use the Site and Services, and all materials provided by KANDINSKY through them, only for lawful purposes and only while these Terms apply. This includes text, images, videos, audio, artwork listings and descriptions, pricing information, software, features, and tools made available to you.
All rights granted to you under these Terms end immediately if your agreement to these Terms is terminated or expires.
KANDINSKY may change, restrict, or stop any part of the Site or Services at any time, temporarily or permanently, with or without notice, and without liability.
2. PROHIBITED USE
2.1 Restrictions on User Content
By using the Site or Services, you agree not to post or share any User Content that:
- Is defamatory, abusive, harassing, threatening, hateful, offensive, violent, vulgar, obscene, or pornographic
- Harms, or is likely to harm, any person or entity
- Is illegal or promotes illegal activity
- Infringes any third-party rights, including:
- Copyright, patent, trademark, trade secret, or other proprietary or contractual rights
- Privacy or publicity rights, including personal information shared without consent
- Confidentiality obligations
- Contains viruses or harmful components, or damages or interferes with the Site, Services, or any connected network
- Violates public forum rules, including age limits or procedural requirements
- Is antisocial, disruptive, or destructive
2.2 Prohibited Activities
You are responsible for all activity under your Account. You agree not to:
- Use the Site or Services without agreeing to these Terms
- Interfere with, or attempt to access, other accounts or computer systems without permission
- Create accounts through automated or fraudulent methods
- Adapt, modify, reverse engineer, or attempt to extract source code or proprietary information
- Use bots, spiders, or automated tools to access the Site
- Reformat, scrape, or manipulate pages of the Site
- Violate any applicable law or regulation
- Provide false or misleading information to KANDINSKY, the Site, or other Users
- Engage in conduct intended to compete with KANDINSKY
- Act in a way that conflicts with the intent or purpose of these Terms
2.3 Enforcement
KANDINSKY does not pre-screen User Content and is not responsible for it. KANDINSKY may remove, edit, or relocate any User Content that violates these Terms.
KANDINSKY may also suspend or terminate your Account or access to the Site or Services at any time, without notice, for any reason, including violations of these Terms. KANDINSKY is not responsible to you or anyone else for any such action.
3. CONTENT OWNERSHIP & COPYRIGHT
3.1 Ownership of Your Content
You retain full ownership of any content you provide through the Site or Services, including text, images, artwork descriptions, listings, metadata, and other materials (“Your Content”). KANDINSKY does not claim ownership of Your Content.
If you choose to make User Content public on your profile or within public collections, you grant KANDINSKY a revocable, non-exclusive licence to use and display that content only as required to operate the Site and Services.
3.2 Intellectual Property and Copyright
Trademarks: The KANDINSKY name, logos, product and service names, brands, and trademarks are owned by Komrade Kiev Ltd. Other displayed trademarks belong to their respective owners. No rights or licences are granted without prior written permission.
Copyright: KANDINSKY may remove content that infringes copyright. Notifications of claimed infringement should be sent to hello@kandinsky.app and must include identification of the copyrighted work, a link to the material, a good faith statement that the use is not authorised, a statement confirming accuracy and authority to act on behalf of the copyright owner, your contact information, and electronic signature.
If content is removed, we will notify you. You may submit a counter-notification including identification of the removed material and its previous location, a statement of ownership or authorisation, explanation of why removal was in error, and your contact information and electronic signature.
4. SUBSCRIPTION, BILLING, TAXES & FEES
4.1 Registration
By registering for the Site and Services, you confirm that you can enter a binding contract and that all information you provide is accurate, current, and complete. You agree to keep this information up to date.
If any information you provide is false or incomplete, KANDINSKY may suspend or terminate your Account and refuse access to the Site and Services.
4.2 Fees
Your first month costs 1 USD, 1 GBP, or 1 EUR. After the introductory month, your Subscription renews at the standard monthly rate of the plan you selected (MANAGE, SELL, or PRO) unless you cancel before renewal.
If you pay your Subscription in a currency other than GBP, our payment provider Stripe will charge a conversion fee of 1 to 4 percent. KANDINSKY does not add any markup. You can avoid this fee by paying your Subscription in GBP with a debit card that does not charge a currency conversion fee.
All plans are billed in advance on a recurring basis. Current pricing for plans and add-on Services is listed on the Site. Fees do not include taxes. You are responsible for any taxes, duties, VAT or charges that apply in your jurisdiction.
KANDINSKY may increase fees at any time by giving at least 30 calendar days notice. Any increase applies at the start of your next Billing Period.
4.3 Payment
By subscribing to the Site and Services, you allow KANDINSKY to charge your payment method for all applicable fees. All fees are non refundable.
Your Subscription renews on the same calendar day each month. Renewals use the pricing and terms in effect at the time of renewal unless you cancel beforehand.
You allow KANDINSKY to charge your payment method for each renewal. If your payment details are removed or not kept current and a payment fails, KANDINSKY will attempt to process the payment up to three times over the next two weeks. If payment is still not received, your Account will be closed. A link to download your data will be emailed to you, and it will expire seven days after closure.
4.4 Plan Changes and Cancellation
You may upgrade, downgrade, or cancel your plan at any time.
Upgrades take effect immediately. An interim invoice is issued for the remainder of the current period and applied to your next invoice.
Downgrades take effect at the start of your next Billing Period. No partial refunds are issued for periods already paid.
You can cancel your Subscription and download your data at any time from your Account page. After cancellation, you may continue using your account until the end of your current Billing Period. To avoid renewal charges, cancellation must occur before your next billing date.
4.5 Referrals
If you refer someone to KANDINSKY and they sign up using your personal referral link or code, both you and the referred user will receive one free month if the referred user remains a paying customer for 90 consecutive days. There is no limit to how many referral rewards you can earn.
Eligibility is confirmed at the end of the 90-day period. The free month is then applied to each user’s next billing cycle.
The free month is based on the plan each user is on at the end of the 90-day period. If either user changes plans during this time, the plan active on day 90 is used.
If the referrer cancels their subscription before the 90-day period ends, the referred user will still receive their free month. If the referred user cancels before completing 90 consecutive days, the referrer will not receive a free month.
Free months are stackable and applied consecutively. They are non-transferable and cannot be exchanged for cash or credit.
After all free months are used, billing resumes on the user’s active plan.
4.6 Tax Obligations
You are responsible for calculating, collecting, reporting, and paying any taxes, duties, or other governmental charges that apply to your use of the Site or Services, in line with the laws of your jurisdiction.
If you are not registered for tax purposes, you remain responsible for any taxes that may still apply.
KANDINSKY has no obligation to collect, remit, or pay taxes on your behalf and is not responsible for any penalties or liabilities arising from your failure to meet your tax obligations.
5. DISCLAIMER, LIMITATION OF LIABILITY & INDEMNITY
5.1 Disclaimer
The Site and Services are provided “as is” and “as available” without any warranties, express or implied. This includes, without limitation, warranties of merchantability, fitness for a particular purpose, or non-infringement.
KANDINSKY does not guarantee that the Site or Services will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components. No advice or information provided by KANDINSKY, its employees, affiliates, or Users constitutes a warranty.
KANDINSKY does not represent or warrant that information on the Site or Services is accurate, complete, current, or meets your expectations. You acknowledge that downtime, computer viruses, and other risks are inherent in using internet-based services and software.
KANDINSKY is not responsible for the actions, conduct, or compliance of other Users. You assume all risk of harm or injury resulting from their use of the Site or Services.
The Site and Services may include links, integrations, or access to third-party websites or services. KANDINSKY does not endorse and is not responsible for the content, products, or services on these third-party sites. Accessing them is at your own risk.
5.2 Limitation of Liability
Your use of the Site and Services is at your own risk. You are responsible for any costs, losses, or damages arising from your use, including reliance on information, opinions, or content on the Site and Services.
KANDINSKY is not liable for any indirect, incidental, special, or consequential losses. This includes, without limitation, loss of revenue, profit, production, business, contracts, opportunities, anticipated savings, data, goodwill, reputation, or use. KANDINSKY is also not liable for claims brought by third parties.
KANDINSKY is not responsible for the deletion, correction, destruction, damage, loss, or failure to store or back up any User Content, data or account information. You confirm that you have all rights and permissions necessary to grant these rights to KANDINSKY.
KANDINSKY is not responsible for interruptions, errors, viruses, or other harmful components that may affect the Site or Services, nor for unauthorized access, alteration, or misuse of your Account, Services, or User Content. You are responsible for keeping your login credentials secure and for all activity under your Account.
You may disclose sensitive or confidential information through the Site or Services. You assume all risk of harm or loss resulting from any disclosure, transmission, or storage of such information.
KANDINSKY’s total liability to you for all claims, whether in contract, tort, or otherwise, is limited to the greater of the fees you paid for the Services in the three months before the event that caused the liability, or £100.
These limitations apply to the fullest extent permitted by law. This Agreement is governed by the laws of England. You submit to the exclusive jurisdiction of the English courts for any disputes arising under this Agreement.
5.3 Indemnity
You agree to indemnify, defend, and hold harmless KANDINSKY, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:
- Your use of the Site or Services;
- Your User Content or conduct;
- Any violation of these Terms; or
- Any infringement of third-party rights.
This indemnity applies whether the claim arises in contract, tort, or otherwise and extends to all reasonable costs, including legal fees.
6. SECURITY
6.1 Data Encryption
KANDINSKY is a cloud-based service built from the ground-up to maintain strong security and data integrity. All communication with the site uses HTTPS with TLS 1.2+ to protect data in transit, and all stored data is encrypted at rest with AES-256.
All content and data you upload is private by default and accessible only to you. If you choose to share artworks through your Public Profile or Collections, KANDINSKY applies further safeguards: images are shown at limited resolution, and you can disable right-click and drag-and-drop downloads from your account page. These controls reduce the risk of unauthorized copying while keeping you in full control of your work.
Access controls, monitoring, and internal policies help keep your information secure. No system is completely secure, but we work to reduce risks. You are responsible for keeping your password confidential.
6.2 Data Back-ups
Our servers run on fully redundant US-based AWS infrastructure with daily backups to keep your information available and recoverable. We apply ongoing security patches and updates to both our codebase and hosting environment, following industry best practices.
6.3 Payments Security
All payments on or to KANDINSKY are processed securely through Stripe. Your payment information, including card details, is encrypted in transit and at rest, and KANDINSKY never stores or has access to this data.
Stripe handles authorisation, settlement, and fraud detection in compliance with global security standards, and we only receive confirmation of completed transactions and the information necessary to provide the Services, such as transaction amount, date, and associated account.
