Information you provide directly: When creating an account, uploading artwork, making purchases, contacting support, or registering for an event. This includes your name, email address, phone number, billing and shipping details, payment information, profile details, and any User Content you upload.

Information collected automatically: When using the Site. This includes IP address, browser type and version, device information, operating system, time zone, pages viewed, clicks, searches, time on page, usage patterns, referring/exit pages, cookies and similar tracking technologies, device identifiers, and technical logs used for diagnostics, security, and performance.

Account, activity, and content data: Related to your use of the Services, such as artwork, inventory, transactions, sales history, customer interactions, team members, permissions, and behaviour within tools or dashboards. This also includes:

  • Data contained within User Content
  • Data derived or extracted from User Content
  • System-generated data such as tags, classifications, and enrichments
  • Structured attributes such as artist name, date of birth, artwork dates, dimensions, medium, pricing, provenance, and other catalogue fields

Communications data: When you contact us or use support features. This includes messages, support requests, and any communication history with us or through the platform.

Information from third parties: From service providers or connected accounts, including payment processors, hosting providers, analytics tools, identity or fraud prevention services, social media platforms, and other services you connect to your account.

2. ACCESS TO THE SITE & SERVICES

You may access and use the Site and Services, and all materials provided by KANDINSKY through them, only for lawful purposes and only while these Terms apply. This includes text, images, videos, audio, artwork listings and descriptions, pricing information, software, features, and tools made available to you.

All rights granted to you under these Terms end immediately if your agreement to these Terms is terminated or expires.

KANDINSKY may change, restrict, or stop any part of the Site or Services at any time, temporarily or permanently, with or without notice, and without liability.

3. HOW WE USE YOUR INFORMATION

We use the information we collect to operate KANDINSKY and provide the Services. This includes managing accounts, hosting profiles, supporting inventory management, processing payments and subscriptions, and handling customer communication.

We use information to maintain, improve, and develop the Site and Services. This includes understanding platform usage, identifying issues, improving features, monitoring system performance, maintaining security, preventing fraud, and testing changes.

We process and analyse your information to operate and improve the Services. This includes building and maintaining core platform functionality, and may include the creation of derived and structured data from User Content and related activity. We may use anonymised and aggregated data for analytics, product development, and commercial purposes. This data does not identify you, your artworks, or your users.

If you delete your account or stop using the Services, we will delete or stop using your personal data within a reasonable period, subject to legal, security, and backup retention requirements. We may retain anonymised and aggregated data that does not identify you, your artworks or your users.

4. WHEN WE SHARE YOUR INFORMATION

We will never sell your User Content, data, or activity.

Information is shared only as required to operate the Site and Services with the following:

Service providers: employees, contractors, and third-party providers performing specific tasks, who only receive the data required to perform their work. Examples include:

  • Sending emails through Amazon SES
  • Processing payments and managing subscriptions through Stripe
  • Hosting cloud infrastructure on AWS & Vercel

Public content: content you make public may be displayed on the Site or KANDINSKY channels. You control whether your profile is public or private.

Legal, safety, and business purposes: we may access, preserve, or disclose information to comply with law, respond to claims (including copyright infringement), enforce our Terms, protect rights, or in the event of a merger, sale, or asset transfer. We may retain copies of your data after account closure for these purposes.

5. COOKIES

Cookies are small text files stored on your device when you visit the Site. They allow the Site to function securely, remember basic preferences, and generate aggregated usage statistics. You can restrict or delete cookies through your browser settings, but some features may not function properly if you do.
